Terms & Conditions
These Terms apply to tutoring, educational support, courses, resource purchases and related services supplied by Malta Tutors. Mandatory rights granted by applicable consumer law are not excluded or restricted by these Terms.
1. Applications, bookings and the right to withdraw
A submitted application is a request for tuition and does not guarantee a particular tutor, timetable, location or start date until confirmed by Malta Tutors. Where a statutory 14-day withdrawal right applies to a distance or off-premises consumer contract, it is preserved in accordance with applicable law. Formal withdrawal should be sent by email to [email protected]. If the consumer expressly requests that a service begins during an applicable withdrawal period, the consumer may be required to pay for services supplied before withdrawal to the extent permitted by law.
2. Cancellation and rescheduling of tuition slots
Requests to cancel or reschedule a tuition slot must be sent at least 48 hours in advance by email to [email protected]. Rescheduling is subject to availability and will normally be sought within the same week or the following week. Where illness prevents attendance, Malta Tutors may request reasonable supporting evidence, including a medical certificate. A session cancelled outside the required procedure may be forfeited and remain payable, subject always to mandatory consumer rights and any exceptional circumstances accepted by Malta Tutors.
3. Termination of ongoing tuition
Ongoing tuition must normally be terminated with at least 3 weeks' written notice by email. Lessons falling within the notice period remain payable whether attended or not, unless Malta Tutors agrees otherwise or applicable law requires otherwise. Where fees remain unpaid, Malta Tutors may suspend further services and pursue lawful recovery remedies.
Short programmes: classes with a duration of less than three months may be terminable, but refunds are subject to the refund provisions below and any mandatory consumer rights.
Discounted programmes: where a discounted rate was expressly conditional on a full academic-period commitment, early termination may result in recalculation of attended lessons at the standard rate and an additional three-week notice charge at the standard rate, to the extent permitted by law and clearly communicated before purchase.
4. Safeguarding and in-home tuition
For in-home tuition involving a minor, a parent, legal guardian or responsible adult designated by the parent/guardian must be present in the home for the duration of the session unless Malta Tutors has approved another safeguarding arrangement in writing. Clients must provide a safe, appropriate learning environment.

Bookings of fewer than 30 hours: an additional €10 per hour is applied on top of the standard one-to-one base rate.
Students attending together: where a group booking is declared at application stage, the relevant base rate and the fewer-than-30-hours additional fee are divided equally among the attendees. In addition, a group-session charge of €10 per hour per student applies. Malta Tutors will confirm the final group rate in writing before tuition begins.
6. Payment and late payment
For the first session, payment must be received no later than 09:00 CET on the scheduled day unless otherwise agreed. Future sessions may be invoiced in advance and payment instructions will be stated on the invoice. The current late-payment administration schedule is: €25 after 10 working days, €50 after 20 working days, and interest at 8% per annum on overdue balances after 30 working days, in each case only to the extent legally enforceable and proportionate.
7. Communication with tutors
Official scheduling, payments, complaints, contractual matters and formal cancellation/termination notices must be handled through Malta Tutors. Direct private engagement of an assigned Malta Tutors tutor outside the Malta Tutors arrangement is prohibited under the non-circumvention clause below.
8. Closed group sessions
If one group member is unable to attend, rescheduling is subject to availability and the agreed group arrangement. If at least one member attends a scheduled group session, the session may remain chargeable. If a group reduces in size, Malta Tutors may recalculate the rate applicable to the remaining participant(s) and will communicate the revised arrangement.
9. Tutor reassignment and change requests
If an assigned tutor becomes unavailable, Malta Tutors may provide a suitable replacement. Students and clients may request a change of tutor. Continuing after the first session without requesting a change normally indicates acceptance of the tutor for the engagement, but does not remove any mandatory consumer right or prevent a later complaint about an objectively substantiated issue.
10. Recording, screenshots and session materials
No lesson may be recorded, screen-captured or redistributed by a tutor, student or third party without the required prior permission and, where personal data is involved, an appropriate lawful basis. Where Malta Tutors proposes occasional recording for quality assurance, training or auditing, recording consent will be requested separately. Approved recordings are for the authorised purpose only and may not be shared or published without permission.
11. Future payments and continuity
Payment for upcoming tuition may be required up to three weeks in advance where stated in the booking or invoice. If circumstances prevent in-person delivery, Malta Tutors may offer online continuation where appropriate; a material change to the agreed service will be handled in accordance with applicable contractual and consumer-law obligations.
12. Refunds
Refund eligibility depends on the type of booking, performance already supplied, the reason for cancellation, the applicable notice provisions and mandatory consumer law. Business classes and fixed-date speciality classes may be sold on a non-refundable basis where this is lawfully agreed in advance. Digital notes or resources that have been supplied or accessed may be subject to the statutory rules applicable to digital content, including any valid request for immediate supply and acknowledgement of the resulting effect on withdrawal rights.
13. Public holidays
No lessons are held on public holidays unless expressly arranged in advance.
14. Trial classes and retaining original slots
If a student attends a trial and wishes the original slot(s) to remain available with the same tutor, the student or parent/guardian should confirm continuation in writing by email or WhatsApp within three days of the trial. Where a trial consists of more than one class, Malta Tutors may request confirmation after the first trial session. If confirmation is not received, the slot may be released and continued availability cannot be guaranteed.
15. Tutor identity, data protection and non-circumvention
Malta Tutors protects tutors' personal data and does not provide clients with unnecessary personal documents or private contact information. Tutor credentials are internally reviewed as part of Malta Tutors' engagement and matching process. Clients must not solicit, employ or engage an assigned Malta Tutors tutor privately in order to bypass Malta Tutors during the engagement or after termination where the restriction is lawful, reasonable and enforceable. This clause is intended to protect Malta Tutors' legitimate business relationships and does not restrict rights that cannot lawfully be waived.
16. Academic integrity, notes and AI-assisted tools
Tutoring, notes, flash cards, sample essays, research guidance and Pocket Tutor© are educational supports. Students remain responsible for complying with the rules of their school, university, examination board or other institution, including rules on plagiarism and use of artificial intelligence. Malta Tutors does not guarantee any particular grade, admission decision or academic outcome.
17. Complaints
Concerns should first be submitted to [email protected] with sufficient information for Malta Tutors to investigate. Nothing in these Terms prevents an eligible consumer from using rights or dispute-resolution mechanisms available under applicable law.
18. Governing law
These Terms are governed by the laws of Malta, without depriving a consumer of mandatory protections that may apply under the law of the consumer's habitual residence where such protections cannot lawfully be excluded.
