How Malta Tutors processes personal data for tutoring, educational support, applications and online services.
Privacy Policy
This policy explains how Malta Tutors collects, uses, shares and protects personal data when you enquire, apply for tuition, purchase educational resources, use Live Chat, interact with Pocket Tutor© or otherwise use our services.
1. Who is responsible for your data
Malta Tutors acts as a data controller where it decides why and how personal data is processed in connection with its tutoring and educational services. Data protection is governed by the General Data Protection Regulation (EU) 2016/679 (GDPR), Malta's Data Protection Act (Cap. 586) and applicable subsidiary legislation.
2. Information we may collect
- Student name, date of birth, sex, contact details, identification details and address where supplied through an application.
- Parent/legal-guardian details for minors.
- School or institution, grade level, examinations, curriculum, subjects, assignments, tuition dates, preferred delivery method and timetable.
- Learning-support or health-related information voluntarily disclosed because it is relevant to the requested educational support.
- Booking, payment, invoicing, attendance, communications, tutor-matching, complaint and customer-service records.
- Website technical data and privacy-preference records.
3. Why we use personal data
We process personal data where necessary to respond to enquiries, take steps at your request before entering a contract, administer and perform tutoring or educational services, manage payments and records, comply with legal obligations, protect legitimate business interests, and where appropriate act on consent.
4. Minors
Where the learner is under 18, the parent or legal guardian is the primary contracting contact unless Malta Tutors agrees otherwise in writing. Information relating to minors is handled with particular care. The separate GDPR rule for consent-based information-society services offered directly to a child is not the same as the contractual requirement for a parent or guardian to authorise tuition for a minor.
5. Learning-support and health information
Information concerning a learner's health, disability or learning profile may constitute special-category personal data. Please disclose only information relevant to the educational service. Where we rely on your explicit consent for such information, you may withdraw that consent, although this will not affect processing already lawfully carried out.
6. Recording of online sessions
Selected online sessions may only be recorded where the required consent and internal authorisation are in place. Recording consent is requested separately from the general tutoring terms so that refusing optional recording does not prevent ordinary tuition.
7. Who may receive data
We may share relevant information with an assigned tutor, authorised Malta Tutors personnel, technology providers, payment or communications providers, professional advisers or competent authorities where necessary and lawful. We do not sell student or client personal data.
8. International processing
Malta Tutors may provide online services internationally. Where personal data is transferred outside the EEA, the transfer must be handled in accordance with applicable GDPR transfer requirements.
9. Retention
Records are retained for periods appropriate to the purpose, including service administration, accounting, dispute handling, contractual enforcement and legal obligations. Data that is no longer reasonably required is deleted or anonymised in accordance with our retention practices.
10. Your rights
Subject to applicable law, you may have rights to access, rectify, erase, restrict or object to processing, receive portable data, and withdraw consent where processing relies on consent. You may also lodge a complaint with Malta's Information and Data Protection Commissioner.
11. Cookies and Live Chat
Optional technologies are controlled through the website's consent interface. Live Chat is not loaded until Functional technologies are enabled. You can reopen at any time.
